Fotome Refund Policy
After payment, you have 7 days to review your results. Before your purchase is confirmed, you may request a full refund through the Company's customer support process or Polar Support.
1. Scope
This Refund Policy applies to purchases of Fotome paid services provided by BrainCheck. Fotome paid services are digital services that generate AI profile photo candidates and make them available for review and download in your account album.
2. Refund Request Before Purchase Confirmation
- You can review your results for 7 days after payment.
- Before your purchase is confirmed, you may request a full refund for a normal transaction.
- Refunds are handled through the Company's customer support process, Polar Support, or the process provided by the payment provider, and may be limited by applicable law, the Company's refund policy, Polar review, fraud prevention, payment method policies, and card network rules.
- After a refund is completed, the Company may restrict or revoke the generation rights, album access, or download rights connected to the order.
3. Refunds After Purchase Confirmation
Your purchase is automatically confirmed 7 days after payment. Refund requests submitted after purchase confirmation are generally limited. However, if a Paid Service is not provided normally due to reasons attributable to the Company and restoration or alternative provision is difficult within a reasonable period, the Company may provide a refund or comparable measure.
4. How to Request a Refund
To request a refund, use the Company's customer support process or find your order through Polar Support. You may also use the order management link in your Polar receipt or payment confirmation email.
- Email address used for payment
- Order number or Polar receipt information
- Payment date and payment amount
- Name of the plan for which you are requesting a refund
Once Polar identifies your order, you can request a refund, review receipts, and make payment-related inquiries through Polar.
5. Refund Method and Timing
- Refunds are generally processed to the original payment method.
- After a refund is approved, the timing of the actual credit or reversal may vary depending on the card issuer, bank, payment processor, or payment method.
- Exchange rates, taxes, international payment fees, card issuer fees, or other external factors may affect the amount displayed or received.
6. Abuse and Exceptions
The Company intends to let users review their results before deciding. However, if clear abuse is suspected, the Company, Polar, or the payment provider may verify necessary facts before processing a refund.
- Suspected payment fraud, stolen card use, account theft, or false payment
- Upload of illegal content, photos of others, photos of minors, or unauthorized photos
- Use for a purpose prohibited or restricted by Polar's Acceptable Use Policy, including adult AI-generated content, deepfakes, face swaps, trademark, copyright, publicity-right, or privacy infringement, personal data exposure, OSINT, fake testimonials, or deceptive advertising
- Repeated abnormal orders and refund requests that appear to abuse the refund process
- Chargebacks, disputes, legal investigations, or payment provider review requirements
Polar or another payment provider may cancel or refund a transaction separately from the Company's default refund policy for payment errors, suspected fraud, chargeback prevention, card network rules, legal obligations, customer protection, or risk management. For payments through Polar, Polar may issue refunds within 60 days of purchase at its own discretion.
7. Service Use After Refund
- After a refund is completed, generation rights, album access, and download rights connected to that order may end.
- Usage rights for refunded Outputs may be revoked.
- Order records necessary for refund handling and dispute response may be retained for the period required by applicable law.
